1. Agreement

By accessing or using hushegarden.com ("the Site") and purchasing products from Hushé ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order. By placing an order you represent that you meet this requirement.

3. Products & Pricing

All product descriptions, images, and prices are subject to change without notice. We reserve the right to limit quantities, refuse orders, or correct pricing errors at our discretion. Colors may vary slightly from those shown on screen due to monitor calibration.

4. Orders & Payment

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order. Payment is processed at the time of order via Shopify Payments and other supported methods. You authorize us to charge the payment method provided for the total amount of the order, including taxes and shipping.

6. Intellectual Property

All content on the Site — including text, images, logos, designs, and the Hushé name — is the property of Hushé or its licensors and is protected by applicable intellectual-property laws. You may not reproduce, distribute, or create derivative works without our written permission.

7. User Conduct

You agree not to use the Site for any unlawful purpose, to upload malicious code, to attempt unauthorized access, or to interfere with the Site's operation.

8. Disclaimers

Products are sold "as is" without warranty of any kind, express or implied, except where required by law. Hushé does not warrant that the Site will be uninterrupted, error-free, or virus-free.

9. Limitation of Liability

To the maximum extent permitted by law, Hushé shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site or any product purchased. Our total liability for any claim shall not exceed the amount you paid for the product in question.

10. Indemnification

You agree to indemnify and hold harmless Hushé, its officers, employees, and affiliates from any claims arising out of your breach of these Terms or your misuse of the Site.

11. Governing Law

These Terms are governed by the laws of the State of New Mexico, United States, where Irongate Commerce LLC is organised, without regard to its conflict-of-law rules. Nothing in these Terms limits any rights you have under the consumer protection laws of the state where you live, and nothing here requires you to give up a remedy those laws give you. If any part of these Terms is found unenforceable, the rest continues to apply.

12. Changes to These Terms

We may update these Terms at any time. The "last updated" date will reflect changes. Continued use of the Site after changes means you accept the revised Terms.
